Q: My son father quit his job a week before appearing for the child support hearing in September of last year and is now currently on unemployment since of last year. He has never supported my son since he was born ,I have never received back pay and now he is currently paying $100 for child support. I am well aware that he is working under the table. Due to his monthly expenses. I also suspect just by going by what he said in the last court hearing ,he told the judge that he will be working as an Uber driver. I was planning on filing for an emergency order of modification but I’m not sure if I should because the unemployment benefits expire Sep 5 and I’m not sure how I will receive monthly payments for child support.

As for the child support case, it depends on what was done last September – if the Court modified the support order, then either one of you would need to have a factual, provable basis to modify it further.
