“In New York State What Is The Morality Clause For Not Having Other People Sleep Over When Kids Are Present?”

  • By: David Bliven
  • Published: July 28, 2022

Q: “Starting to look up info on divorce. Husband already has a girlfriend. We have two children together who are minors…”

A: “There is no “morality clause” – meaning a standard clause of that sort inserted into agreements or orders. This issue is fact-specific, as it depends on a host of issues: the ages of the children, whether the girlfriend has been appropriately introduced to the children, the stage of the proceedings, the appropriateness of the Husband as well as the girlfriend vis-a–vis the children (e.g., do either have psych issues, drug/alcohol issues, etc.). For a full assessment, call a Westchester Divorce Attorney to schedule a consultation.”
