Can cps force me to send my kids to school with the pandemic? Do I have the right to homeschool my kids without been interrogated?

  • By: David Bliven

Q: Im a cancer patient n my kids are asthmatic my kids are con seen n I’m concerned. My son is having anxiety he as l most die last year n he is scared

A: If the school district you’re in is not offering remote learning, then you’d either need to send them to school, apply for & be approved for home schooling – or run the risk of a child neglect case being filed against you. You may wish to look into applying for an exemption (if the school district offers that). Assuming you live in NYC, one method is to apply for “medically necessary [out-of-school] instruction” -https://www.schools.nyc.gov/learning/programs/medically-necessary-instruction. Schedule a consult with a NYC Family Law attorney for a full assessment.
