How does Child Support change if child moves in with non-custodial parent full time?

  • By: David Bliven

Q: My child, who is 16 decided to move in with me full time and we live in NYS. I already petitioned the court to terminate the current order that requires me to pay my ex. Now that my child lives with me full time, am I am to apply for child support from my ex? My ex and I were never married.

A: Yes, you can also file a petition to request child support to you. Moreover, if there’s a current custody decree in place, I’d recommend to file a petition for an order reflecting the change. Schedule a consult with a Westchester Child Support attorney for a full assessment.
