I recently found out that my child’s father has been lying about where he lives and had our child at that undisclosed location. What can I do about this situation?

Q: I am in a custody battle, my son father has visitation on weekends from 10am to 6pm. He doesn’t have a proper living situation so he told me and the mediator that he will have parenting time at his sisters home, however he did not have my son there it was at a different location. He doesn’t communicate with me about my child and is requesting full custody.

A: You should keep a paper-trail with him and ask him where the child was during the visit. Unless the interim order restricts him to the sister’s house, he’s certainly entitled to take the child anywhere (within reason) during the visit – but if he has the child sleeping elsewhere or there are safety issues, you should bring the issue to the attention of the Court. Schedule a consult with a Bronx Child Custody attorney for a full assessment.
