Is my husband entitled to any of the money from my personal injury settlement?

Q: My son and I were involved in a car accident, but my husband keeps trying to control my portion of the settlement because we’re married. He feels entitled to it and says it’s his money too. Is that true? And if we were to get a divorce, would he have any claim to that money?

A: Generally personal injury proceeds are one’s separate property – meaning he would generally NOT share in such funds. The key to preserving that asset as “separate” would be to segregate the funds – meaning when you receive the money, open a brand new account & then don’t make any other deposits into that account.
