Will I have to still pay child support if I’m the only parent providing for my child and I pay for daycare ?

  • By: David Bliven

Q: My child mother threatened to put me on child support but doesn’t provide anything for our child I pay for the daycare care, she leaves whom with me longer than our joint custody agreement and never have any money to provide anything for our child.

A: If you’re the non-custodial parent, then you owe child support to the custodial parent. That said, childcare should be paid pro-rata. If there’s an issue of you wanting the child to live with you the majority of the time, then your move is to file for custody. Schedule a consult with a Bronx Child Support Attorney for a full assessment.
