Q: My husband and i worked with a mediator and reached a settlement that we signed and notarized and i delivered upon with in 10 days of signing. we also signed and notarized all other papers needed. he didn’t sign one, the paper that stated he was aware he’d need to cover his own health insurance. he seemed to wanted to use it as leverage for getting one of our pets. Both i and the paralegal contacted him several times asking to send the last piece of paper and he never responded. The paralegal and i decided to file without it. I’m wondering if you think that will stand in the way of the divorce going through. it has been 3 months since i filed and i have not heard yet. what should i do
A: David’s Answer: Was the summons accompanied by the notice? And/or was it contained within your stipulation of settlement? If it was one of those, you’re safe. Otherwise, this is jurisdictional & the Court will require proof he received the notice.
