Q– i have had sole legal / physical custody of my son since May, 2014. Father in and out of his life. no financial contribution b/c he feels my family has financial means and in his words “he will pay for him when he’s with me.” hasn’t seen son since May, 2020. communication is not consistent at this point b/c child is no longer interested because of the emotionally abusive behavior by father. father moved to Fla in Aug of 2020. has filed for full or 50/50 custody 14 times since 2013. I finally filed for child support in 2021. final order of $96 a week + 26% of all medical was finalized in 2022. He’s paid $456 total with $16K + in arrears. he Just recently filed for custody again in March, 2024. judge we had since 2014 recused herself. reassigned judge (1 hearing before her in April, 2024) recused herself for a hearing that was to be on 5/24/24. 4th new judge assigned and now we have a settlement conference date pending. Child has been assigned an attorney in this case.

A- The short answer is that Judges usually schedule conferences prior to scheduling a trial. That said, you have the option of trying to speed up the process by either filing a motion to dismiss or motion for summary judgment. Schedule a consult with a White Plains Divorce Attorney for a full assessment.
