What happens when the defendant in a child support case doesn’t answer the summons/appear in court after being served?

  • By: David Bliven

Q: I filed with family court to have them enforce child support. He didn’t show for the first virtual appearance so I had to have him served. We go again on Thursday, don’t think he will appear. He’s an alcoholic who isn’t even replying to his kid’s texts any more.

A: It depends on whether he was validly served more than 8 days before the court date – and you’ll submit an affidavit of service to that effect. If that’s the case, then the court ca proceed to inquest on your petition. Schedule a consult with a White Plains Child Support Attorney for a full assessment.
