What counts towards the 10 year marriage rule to collect on Spouse’s SSI?

Q: I was married for a little over 9 years and then my wife filed for divorce. We were separated for about 8 months and she finally signed the divorce agreement 3 days after what would’ve been our 10 year anniversary. Given the fact that we were no longer living together as man and wife, is she entitled to collect SSI from my benefits?

A: She may be able to collect benefits using your social security number – but the key thing for you is that it wouldn’t affect your benefits one iota. That’s indeed why social security benefits are not divisible “assets” in a divorce case. Call a Westchester Divorce Attorney for more info.
