Q– There were three kids involved in the child support case, since the one child has turn 21 3 years ago the mother was evicted from her home and we agreed that my two sons would live with me until she was able to secure a home. During that time the child support was suspended by the court, the children went back for the summer and was supposed to return. The mother was unable to secure a place for them to live, after several broken agreements for the children to return I notified CPS that the children was not enrolled in school. Mother and my sons moved to Atlanta to stay with my sister, once my oldest turned 18 he dropped out of school. My sister informed the mother that the arrangement isn’t working and she needs to leave.
The mother returned to yonkers and stayed in a hotel for about a year. My oldest son moved to Miami to find work. After finding out of her living arrangements I once again offered for my son to come and live with me. He returned and lived with me unfortunately he didn’t want to complete his school assignments and was failing school. I gave him an ultimatum and he choose to leave and return back to NY.

A- It’s hard to say without an analysis of all the facts & factors involved in your case (particularly the incomes). The list of the factors the Court considers is contained in the following Legal Guide: https://www.avvo.com/legal-guides/ugc/what-are-the-factors-in-deviating-from-guidelines-child-support-. You’re best advised to schedule a consult with a Westchester Family Law Attorney.
