Q: Someone is claiming I fathered a child 7 years ago – she is a Colombian national and had been in the US on a student visa she returned to Columbia while pregnant and has lived there ever since . Paternity has not been verified and due to life circumstances as the time and how insane she was acting and threatening me I had cut ties with her . If I do want to establish paternity moving forward 1) what are my rights ? 2) what are my obligations – specifically what kind of statue of limitations is there on child support and what would be expected of me?
A: If the child’s been living in Columbia for nearly 7 years, then it’s questionable whether a NY court will have jurisdiction over the paternity case. Even so, NY assuredly would not have jurisdiction over any visitation case. As such, you may be better off pursuing the case in Columbia. That said, for a definitive opinion, you’re best advised to schedule a consult with a White Plains Family Law Attorney.
