  • By: David Bliven

Q– The father breached the custody order in the following ways.
1. Have not allowed child to call me for 2 weeks and ignore my calls. He is suppose to call me once a day
2. Father traveled with child to out of state And did not send travel info 14 days prior as stipulated. No accomadatios ,tramsaportstuin Info was sent either. The morning of the trip because I begged he send only flight info. But it was to another state than what the child told me.
3. I am suppose to have child’s passport in even yrs, he is withholding it.
4. I called child and he is driving the child state to state without a carseat which the stipulation says he should have carseat.
5. Child doctor ordered he cannot be vegan due to malnutrition and recent hospitalization and father is not following the order and says it’s nonsense. It under a major decision in the stip but father will not help woth child weight gain.
6. Father always interrupts the calls with child Telling the child what to say to me.

A– I’d recommend to first send a “default notice letter,” putting him on notice of the alleged violations & ask for his response/remedy. You may also wish to consult your agreement regarding the procedures in relation to alleged violations/defaults. Schedule a consult with a White Plains Child Custody attorney for a full assessment.
