Seeking more information on family court adjournments

Q– I’m pro se right now in family court regarding denial of access. (there’s an agreement in place for 7yrs). the ex has avoided 7 attempts at being served. we have a court date this monday at 10am. the ex emails me Friday night saying “forms were submitted for an adjournment.”
what are the rules for doing this? If i have a 10am hearing, when the heck does the judge rule on this? when and how do i get notified? i thought you had to show up, then request an adjournment. do i get a say in this? where can i read up on family court adjournments?

 

A– First, your ex should have copied on on the correspondence to the Court. You can request s/he send you what they sent to the Court – or you may retrieve it from the clerk’s office. Second, whether the Judge will grant the adjournment is in the discretion of the Judge based on the circumstances s/he presented as a basis to adjourn. Third, the good news is that if s/he submitted this correspondence to the Court but did not register a jurisdictional objection, then the Court will deem him/her served.
