Q: Hello. I am a Russian citizen and moved to the US in March 2023. I had a son in the marriage, then we got divorced and my ex-husband banned the child from leaving the country, but I have 100% custody, I live in California, my ex-husband lives in New York. If he makes a visitation schedule, how long can my son fly to him (my son is 14 months old)? And if he asks for custody, what are his chances? Also, is there a chance for me to lift the ban on my child leaving the country? Now we are in the process of another trial regarding alimony and as far as I know he makes his tax returns different from what he actually has, that is, he hides his income. There is also a question about this, how can this be tracked?
A: I’m unclear what your question is regarding visitation. As for custody, there are numerous factors which must be analyzed in a custody determination – checkout my Legal Guide on the subject: https://www.avvo.com/legal-guides/ugc/what-factors-are-considered-for-child-custody-. As for tracking income, there are a variety of ways to do this – including disclosure, investigators, forensic accountants & subpoenas. You’re best advised to schedule a consult with a Westchester Divorce Attorney for a full assessment.
