My husband wants to take our child for a few days, but I don’t know where he lives. What are my rights?

Q: Husband filed for divorce months ago. We have had informal discussions with our attorneys, but haven’t gone to court. We have don’t have any agreed to settlements. While living in the house he took responsibility for our child 2 days per week and alternating weekends. He recently moved out and wants to take our child for a few days, but I don’t know where he lives or if he’s living alone. Can I demand to see his new place before allowing him to take our child to see if it’s an appropriate place and who else might be residing there? If he says no, can I refuse to release our child to him?

A: First, you should definitely have an address for him. God forbid, it something happens to him while the kids are with him, you’d need to know where you could retrieve your children. Second, you are entitled to 1 of 3 things: (a) to inspect his apartment/house, (b) to ask for a home study by Probation/CPS, or (c) at the least that he provide video/pics of the place to ensure appropriate accommodations.
