My child lives with me. How do I get child support enforcers to stop the payment to Custodian parent?

Q: My daughter lives with me 24/7 365 days of the week and every time I go to the enforcers office they want something different to prove the situation.

Q: What does warrant of satisfaction of Judgment mean?

A: I've not heard of "warrant of satisfaction of Judgment" within the context of child support. A warrant is a police-enforced demand that he appear in court. A "Satisfaction of Judgment" usually means he paid what he was supposed to pursuant to a money judgment. Schedule a consult with a Bronx Child Support attorney for a full assessment.

Q: Relocation from New York to Maryland?

A: Preliminarily, this seems more of a child custody question than a child support question. That said, the focus would be more on your reasons for the move & how you believe the move would benefit the child. If your plan is to file a custody relocation case, then I'd also suggest to file a petition to increase support. Schedule a consult with a Bronx Child Support attorney for a full assessment.

Q: How do i go about this? What do i need? What can happen if everything isn't accounted for , as in evidence wise?

A: If he petitioned to terminate support, then if your son is living on his own & self-supporting, then support should be terminated. That said, generally the court can only grant the father relief retroactive to the date of his petition. Schedule a consult with a Bronx Child Support attorney for a full assessment.

Q: When I went to court for child support, since he was on unemployment he was ordered to provide medical coverage only.

A: If there was no court order requiring him to pay a specific amount, then you're not owed any back money. That said, the Court does have the power to "impute" income to him based on his ability to earn income, so I'd suggest to file a modification petition. Q: Does my step son being gay help me to get full custody of my biological son in a divorce?

A: First, there's zero evidence that one sibling being gay would somehow influence another sibling to be gay. With due respect, this is very pre-1980's thinking. Second, the fact that one step-sibling is gay would have zero effect on the child custody case. Schedule a consult with a Bronx Child Custody attorney for a full assessment.

Q: How can I prove I've been financially supporting my child?

A: If you were paying her money out of your checking account, then you'd have a record. If you were giving her cash, then she'd either need to acknowledge it, or you could attempt to prove it with circumstantial evidence (e.g., withdrawals from your bank account in consistent amounts). Q: Do your child start getting the check themselves at age of 18 or the mother still get it

Unless the child is emancipated, then under these circumstances you can only file a petition for a change of payee. If the child wishes to independently receive the child support, then the child herself would need to be a party to the case. Q: Up to how old does a child have to be to continue receiving child support

A: In New York State, the age of emancipation for child support is 21. Even if the child's working, they'd need to be completely self-supporting for the courts to consider them emancipated. Schedule a consult with a Bronx Child Support attorney for a full assessment.
