Q: Our 9yr old son has asthma and is on a daily medication. He travels between homes weekly. I have sent my son’s father four email communication regarding his medicine not being taken consistently when he is at his home. I believe when he is at his father’s house he is also taken the wrong medication as he is on two different meds for his asthma, one was used when it should have not been. Dad is not monitoring the use. I have given the father the MD info so he can speak with him and get educated on the meds, but dad has not made any calls. I even explain to his father that the MD is not seeing a change in our sons breathing for the last two visit because the medicine is not being taken properly. Can I bring this up in court as well?
A: You should indeed bring it up in court – if not file a motion on the issue. Moreover, you should ask the pediatrician whether s/he believes the Father is committing child neglect – if so, Doctors are mandated reporters & should make a report to CPS if they believe neglect is occurring.
