If I’m put on child support with joint custody will I have to pay the whole daycare , mother of my child doesn’t follow court?

  • By: David Bliven

Q: I’m going to court , mother of my child put me on child support it wasn’t granted yet, we share joint custody but she doesn’t follow the court order leave him with me longer than he’s supposed to be, she went to file child support paperwork but I pay for the day care and pay for a sitter when she doesn’t pick him up, my question is if I’m placed on child support will I have to pay the whole daycare care bill?

A: You can have the Court apportion the childcare on a pro-rata basis, as the mother should contribute towards childcare as well. If you have shared access or nearly so, then perhaps you should think about moving for a court order to confirm the shared access. Schedule a consult with a Bronx Child Support attorney for a full assessment.
