Q: I’m currently on child support, have been for the past 4 years. I’m not on the child’s birth certificate and do not want any contact or visitation with the child due to her mother putting a case on me for false accusations in the past. I wanted to know if I have rights and if I do can i sign them over? And since I am on child support do I have to have any contact or visitation?
A: Visitation is a right but not an obligation. And no – once an order of filiation is set by the court, you cannot “sign over your parental rights” unless the mother at some point wants her significant other to adopt the child. For more info, call a Bronx Family Law attorney.
