Q: I was sent divorced papers, with no assets split. However, I’ve been more than 10 years in our marriage. He had pension during our marriage. He divorced me and send the divorced papers to me in Puerto Rico. We have lived in New york City and his employment pension is NYSers and Dc37. So, I’m wondering, if I’m entitled to apply? By the way ironically, we were both succumb to our disabilities… On the year he filed for disability and he was approved early pension. With the prospective of him receiving Pension and social security during and upto the end of our marriage. My disability and recovery time from brain surgery was depressing/ anxiety and I couldn’t fight my rights then.
A: If you’re already divorced, then what rights you have to his pension would be derived from what your divorce settlement agreement provides (and/or what the Judgement of Divorce states). If your divorce is still pending, then you’d need to retain an attorney to ensure your rights are protected. Schedule a consultation with a Bronx Divorce Attorney for a full assessment.
