I Have A Visitation Matter Re Our Twins, Coming Before Our Divorce Judge In Supreme Court. I Was Seriously Mentally Ill 10 .

Q: years ago and was successfully treated. I dutifully take my meds, just as a precaution against a relapse. and have not had so much as a depressive day since. My wife will have physical custody and we will have joint legal custody; that has been agree on. I want unsupervised visitation. I’ve earned it after all these years and my wife, just to be difficult, opposes it. The main problem now, is that I was evaluated by a forensic psychologist, who knows about my illness. I found a case of his on Google, “for all to see”, and he is going to testify in court. Can the “damaging” info. be testified to “off the record”? “Nobody” knows about my illness and I’m a highly-respected professional in my field. I am afraid!

A: David’s Answer: I’m confused as to how you could have joint custody, yet have supervised visits. Joint custody usually presumes the non-custodial parent is very involved with the children’s lives, which seems to contradict a request for supervised visits. That said, the forensic psych can’t testify “off the record,” and if he recommends supervised visits, then line up your own forensic psych to testify in rebuttal. Schedule a consult with a Rockland/Westchester Family Law attorney for a full assessment.
