I have a order of protection against my son. He wants to come and get his personal property at my house. What should I do?

  • By: David Bliven

Q- My son tried to choke me. He was arrested. The court issued me an order of protection. He contacted me to come and get his personal property out of my house. What do I say to him.

A- It depends on whether it’s a “stay away” OP. If it is, then he either (a) needs to come with police escort (if you agree to same), or (b) he needs a further court order addressing the retrieval. If you just have a “usual terms” OP, then its up to you & your comfort-level. At the least, you should have someone else present in such instance. Schedule a consult with a Westchester Family Law attorney for a full assessment.
