Q– My industry (TV) tanked and I’m unemployed. Before this, last year when I was working steadily, I got a slight downward Child Support modification (Feb 2023). Now, over a year later with no work (I’m looking at jobs out of my sector, for far less money than I used to earn), I’m almost out of savings and wonder if I can file for another downward modification? My ex would most likely fight it, but I’m about to go broke.
A- Unless you have an agreement which says otherwise, each party may file for a modification of their income changed by more than 15% since the last order was set. As such, if that’s your situation, you’d qualify. However, as a necessary element of your case, be prepared to document to the Court that you’ve lost your last job thru no fault of your own & you’ve made diligent efforts to find new work commensurate with prior earnings, education & skills.
