How to prevent grandmother’s visitation rights after I moved to South Carolina?

  • By: David Bliven

Q. I have full residential custody of my daughter, and her grandmother, who lives in New York, filed for visitation after I moved to South Carolina. Despite this, she has sent threatening texts, disparaged another child of mine, and made no further contact after my move. The father and the grandmother have severe enmeshment issues. The grandmother’s actions seem to be more about control than genuine care for my daughter. How can I prevent her from gaining visitation rights, considering these circumstances?

A. Are there any prior orders of custody/visitation in New York? If not & if you’ve been residing in S.C. for more than 6 months, then S.C. would have jurisdiction over any conceivable grandparent visitation issue. If that’s not the case, however, then you should schedule a consult with a NYC Child Custody Attorney for a full assessment & evaluation of your case.
