Q: I have a child with my ex whom the mother is seeking child support, while I understand and don’t mind paying I want to ensure that it doesn’t take away from the support that I need to have for my other two children as I am the sole income, what should I do? should I get a court order before my court date saying the amount I provide to my other two children?
A: If you’re separated from the mother of the 2 non-subject children, then you have an option to EITHER get a court order of child support in place, OR get a valid agreement drawn-up by an attorney setting forth your support obligation. That said, if the mother “seeking support” has already filed her Petition, then you may not be entitled to the credit regarding the non-subject children.
