How can I transfer a family case from Brooklyn to Westchester, NY, where my child and I reside?

  • By: David Bliven

Q. I am currently involved in a family matter case that I initially filed while temporarily living in Brooklyn, New York. Both my child and I now reside in Westchester. I would like to move the case to Westchester as it would be more convenient for us. There are no existing custody or support arrangements in Brooklyn to consider. Could you advise on how I can proceed with transferring this case to Westchester?

A. When you say “There are no existing custody or support arrangements in Brooklyn to consider,” I assume you mean there are no court orders addressing those issues. If there’s pending cases on such issues, then it may depend on how far along those cases are. If there are no prior court orders & no pending cases, then simply file a Petition in Westchester. Schedule a consult with a Westchester Family Law Attorney for a full assessment.
