How can I get full custody of my children from my partner who has refused mental health treatment ?

Q: My partner and I are traditionally married in Ghana and share 2 children, 2 years old boy and soon to be born baby girl. He has a history of mental illness and has refused treatment and medications. He’s always recording me especially when he triggers me. He has become very religious and says something is after our 2 years old. There’s being some concerns where he would pour anointing oil on our child and it would be going into his eyes and our son could barely open his eyes. He would bathe our son with salt water and anointing oil and even attempted to give our son communion and communion wine. He does not believe in medical treatment anymore just religious focus. Whiles he was taking care of my son he refused to feed him any food I made and would cook own food for baby even sometimes the rice was uncooked and he was about 16 months at the time. Recently he tried to give our son anointing oil from Ghana after he returned.

I am very concerned and want full custody of our children because I do not trust him to make sound decisions. What do I do please and how do I go about it?

A: The first thing you’d need to do is file for divorce. Second, if you feel he’s a danger to the children, then you need to separate yourself & the children from the situation. As such, you’re best advised to file an “order to show cause” (via an attorney) seeking temporary custody & possibly a protection order as well. Schedule a consult with a Bronx Child Custody Attorney for a full assessment.
