Do I still need to complete the address confidentiality affidavit or even alert the father that I have moved?

  • By: David Bliven

Q: I have provided the courts with my new address and informed the clerk that I want for my address to remain confidential. Both the father and I have temp order of protection however not full stay away orders. The clerk did not request that I fill out or submit a form to keep my address confidential however she listed my address as confidential. The father communicates with me is via email. I did not directly provide him with my new cellphone number however he has my job and work cellphone number. Our children also have all my numbers work and personal listed in their phones which he has access to.

A: The answer is yes, you should submit an address confidentiality affidavit as well as a proposed confidentiality order. If the Father wishes to file a petition on the case – but doesn’t have an address to serve you at – it would work an unfairness on him (you certainly wouldn’t want the shoe to be on the other foot).
