Do I have full custody of my son being that my son’s biological father wasn’t around nor did he sign birth certificate ?

Q- I found out about a month in almost 2 months ago the paternity of my 6 month old son, my ex boyfriend was the one who signed my sons’s birth certificate and gave him his last name and signed Acknowledgment of paternity but now after telling biological father the results he didn’t believe till he took his own test and now wants to take 50% custody of my son. He has no clue on raising a child everytime I try to show him how to take care of his son we tend to bump heads. And now threatening to try to take my son away from me.

 

A- The only way to establish legal custody is to get a court order. Your child residing with yo is only considered “de facto custody.” Especially if the father’s aiming to dispute custody, you should file a Petition in Family Court asap.
