Do I ask for a remedy/penalty?

  • By: David Bliven

Q: I’m representing myself and planning to take my ex to court because she wouldn’t let me see our daughter yesterday on her birthday, last Christmas, during four months of COVID, and on several other occasions. In the court filing, should I request a remedy or a punishment? If all I get is just make-up parenting time, I won’t be satisfied.

A: You don’t necessarily need to specify a sanction in the Petition. That said, if you’re looking to modify the prior order in some fashion, then it’s best you file a Modification Petition as well. Schedule a consult with a Westchester family law attorney for a full assessment.
