Can My Child’s Mother Move To A Different State If There Is A Joint Custody Agreement In Place?

Q: My child’s mother recently told me that she is moving to Florida with our son, we didn’t discuss it she just dropped the bomb on me. What can I do to stop this from happening?

A: Generally speaking – no. At the least, you should send her an e-mail documenting the fact that you’re objecting to the move. If she’s speaking like the move “is going to happen” within the next few weeks/months, then you can file an order to show cause in Family Court asking for a court order preventing the move.
