Can I have two ongoing divorce in different countries at the same time?

Q: I filed for divorce in Dominican republic (where I got married). Because of the pandemic the procedure are stalled an there is no date available on when I can expect to get a divorce. My husband and I are both Dominican/ US citizens we both live in New York. He won’t sign the divorce because of his religion but he won’t contest it. Since I want to purchase a property and need a divorce decree as soon as possible. Can I file for divorce in NY even though I already filed for divorce in Dominican Republic?

A: No – the NY courts require that you certify no action for divorce is pending elsewhere. Thus, I’d recommend that you withdraw the DR divorce so you may proceed here in NY. Call a Bronx Divorce Attorney for more info.
