Can I As The Petitioner Get Into Trouble??

Q: I pressed charges against my bf but i want to drop the charges i spoke to his attorney and he said if i want to drop the charges i shouldnt appear on the court date and hes going to tell the judge that i want to drop the charges and automatically everything is going to get dismissed but is this possible i dont want to get into trouble for not appearing at court since this was for a domestic violence case??

A: David’s Answer: Is this case in criminal court or Family Court? If in criminal court, then you don’t have the authority to “drop the charges,” as that’s up to the DA. If in Family Court, you’re always free to withdraw your petition without prejudice.
