Does The Custodial Parent Have An Obligation To Apply For Financial Aid?

Q: The other parent (who has always handled child’s finances) is taking me to court to pay more tuition but after 2 college years hasn’t applied for financial aid. Is that a defense against paying more?

A: Generally it’s in both parent’s interests to apply for all grants & scholarships the child would be eligible for. That said, the custodial parent would not have a legal obligation to do so (to my knowledge). Schedule a consult with a Westchester Child Support attorney for a full assessment.
