Family Court Summons For Paternity/support Was Sent To My Son By Mail, He Also Received Ny Sheriff Office Letter ?

  • By: David Bliven, Esq.
  • Published: December 19, 2018

Q: The summons was initiated by my son’s baby’s mom who lives with my grandson in Nebraska. She seems to be requesting more money from him and she doesn’t want him to have custody or visitation. They were never married.

Bronx Family Court date is November 1, 2018.

A: Technically he’s entitled to “actual notice” of the court date, so if he wasn’t served in a manner in which he signed for the delivery (i.e., certified mail), then he’s probably safe in skipping the court date. That said, doing would only delay the inevitable. He’s best advised to schedule a consult with a Bronx Child Support attorney for a full assessment.
