Why would your attorney want you to attend deposition of spouse in divorce case?

Q: Difficult Divorce in white Plains Supreme Court . I’m wife, defendant. I’m non income spouse. Twenty year marriage. I’ve given my deposition already. He was there. Personally I’d rather not go due too his negative behavior towards me, even in court.

A: I (almost) always advise my clients to attend my deposition of their spouse, simply because my client is in a better position than me of knowing whether their spouse is misleading on certain issues. My client can also advise my on follow-up or additional probing questions which I may not have thought of (even attorneys are not perfect). That said, it is indeed optional.
