& if I say no to it?

Q: WHAT HAPPENS IF I SAY NO TO THE DNA TEST? Since he is not the father.

A: David’s Answer: Assuming a paternity case has been filed in Family Court, and assuming you’re the mother, then if you refuse to take the child to the DNA test, the Court will assume he’s the Father (on your default) and enter an order of filiation declaring him the legal father of the child. As an order, once entered, is extremely hard to vacate, you’re highly advised to comply with the test. Schedule a consult with a Bronx Family Law attorney for a full assessment.
