| Nov 22, 2016 | Uncategorized

Q: AT 630 A.M 6/30/16 NYPD BURST THREW MY FRONT DOOR. POINTING AUTOMATIC WEAPONS AT MY 22 YEAR OLD 5 1/2 MONTHS PREGNANT NIECE THREW HER TO THE GROUND GUNS TO HER HEAD. BURST INTO MY DAUGHTER ROOM WHO IS NURSING A 3 WEEK OLD BABY. TOSSES HER TO THE FLOOR CAUSING SMALL GASH ON RIGHT ARM GUNS ON HER ALSO. THERE 46 YEAR OLD GRANDMOTHER IS ALSO THROWN TO THE GROUND NAKED GUNS TO HER HEAD I ROLLED TO FOOT OF BED AND WAS KICKED TO THE GROUND, GUN TO MY HEAD. I WOULD LIKE TO KNOW IS:1 DO THE POLICE ASK HOUSING TO DO A NO KNOCK SEARCH? 2 HOW DO THEY NO THE AMOUNT OF PEOPLE,AGE,GENDER OF PLACE NO KNOCK SEARCH IS BEING CONDUCTED? DON’T HOUSING HAVE A LIST OF THERE TENANT? BECAUSE THERE IS NO WAY I WOULD HAVE LET THEM DO A NO KNOCK SEARCH ON A 22 YEAR OLD PREGNANT GIRL WITH A 3 WEEK OLD N NEXT BEING WATCHED BY THE GRANDMOTHER. WHERE IS THE THREAT TO OFFICERS SAFETY? TO OK A NO KNOCK SEARCH

A: David’s Answer: To do a “no knock” raid, the police generally would need a warrant. The issue in your case, given that the police presumably had a “no knock” warrant (although this would obviously need to be verified) is whether they mis-represented the facts to the Judge to get his/her approval for the no-knock warrant. Schedule a consult with a Bronx Civil Rights attorney for a full assessment.
