2 marriages to 2 different people by mistake (NY/NJ)...I'm terrified...please help

Q:  I got married in NY about 10 years ago when I was 21. Due to domestic violence I left the marriage 2 months after. My ex prepared the divorce papers and I signed them. I never got a divorce papers from court. I was just happy to be out of the relationship and stupidly never followed up.

I met my current husband (#2) 3 years ago. We got married in NJ. NJ issued a license and then a marriage certificate. Unfortunately we are getting divorced. It's an amicable split. I went to get my divorce #1 info and to my surprise found out I was still married to husband #1!!! He never filed divorce papers!!!

What do I do? Researching seems like my 2nd marriage was never valid. Is that true? Do I need to divorce #1? Or #2? Or both? Which one do I file first? I am worried that I'm in legal trouble now!!

A:  David's Answer:  If you never divorced #1 & wish to, then yes, you'll need to file a divorce case. As for #2, if it's certain you never divorced from #1, then you can file an annulment action against #2. Schedule a consult with a NYC Divorce attorney for a full assessment. -- David Bliven, Bronx Divorce attorney (
