If the Affidavit of Service is notarized, do I still need the Affidavit of defendant notarized?

Q: I got her friend to sign and notarize the Affidavit of Service, I want to know if she still needs to sign the Affidavit of Defendant for me to continue with the divorce?

A: David's Answer: Technically if your spouse was personally served with the summons & you submit valid proof of same, then you don't need the Affidavit of Defendant. Generally, if your spouse doesn't answer the summons, you can proceed on default. Call a Bronx Divorce Attorney for more info. -- David Bliven, Bronx Divorce attorney (
