Q: Hi, if during I am married I receive money from of a car accident claim, where I had surgery, if in the future I divorce of my wife I have to split the money received from of the car accident with my ex wife. Thanks.
A: David’s Answer: Personal Injury awards are generally one’s separate property – meaning she generally would not get a share of the award. However, if you co-mingle the funds (i.e., deposit it into a joint account, or take marital funds & deposit them into the account holding the P.I. award proceeds), they may lose their separate property character.
