Q: I’m filing for uncontested divorce in New York. I have already filed UD-1a (summons) and UD-2 (verified complaint) and purchased an index number. The complaint includes the statement: “THIRD: The Plaintiff and the Defendant were married on xxx in New York, New York County, NY.
The marriage was performed by a clergyman, minister or by a leader for the Society for Ethical Culture. I will take prior to the entry of final judgment all steps solely within my power to the best of my knowledge to remove any barrier to the Defendant’s remarriage.”
I did not file form UD-4 when I filed the other papers (which are now time stamped) and purchased the index number.
A: David’s Answer: Generally the Statement of Removal of Barriers to Remarriage must be filed. Instructions are available on the NYS Court’s website. Call a NYC Uncontested Divorce attorney for more info. – David Bliven, Bronx Uncontested Divorce Attorney, (www.Blivenlaw.net)
