Q: recently i was given temporary custody, temporary order of protection, the right to retrieve my belongings, and a scheduled custody hearing in a few days. when i went to pick up my belongings i was serve with another custody hearing schedule for a different day, in another court. my case is schedule in a few days while the other case is schedule in a few weeks. although it appears his case was filed first. i am not sure which court will hear my case. i am not sure which hearing a must attend.
A: David’s Answer: As both are scheduled, you must attend both. You should bring the other case to the 1st Judge’s attention as there can’t be dueling custody cases in different courts – 1 court must decide to take the case.
