Q: if a person lies under oath in a domestic violence trial there won’t be any serious charges on the person will there? People say perjury all the time but in most cases this doesn’t happen. Am I correct or wrong?
A: David’s Answer: Is this Criminal Court or Family Court? Yes, a perjury prosecution is a possibility. If in Family Court, the Judge may consider this (if clearly proven) in giving the party a longer order of protection (if its the respondent who lied), or dismissing the case (if its the petitioner who lied).
